Veteran corporate, bankruptcy and data privacy lawyer Luis Salazar, founder of Salazar Law, LLP, has been appointed the Consumer Privacy Ombudsman in the Alamo Drafthouse Cinemas case (Alamo Drafthouse Cinemas Holdings LLC, 21-10474, United States Bankruptcy Court for the District of Delaware).
Alamo Drafthouse Cinemas Holdings, a dine-in theater chain with more than 40 theaters across the U.S., filed for Chapter 11 bankruptcy in March 2021 to address financial troubles resulting from the Covid-19 pandemic. A plan is already in place for investors to buy Alamo Drafthouse Cinemas out of bankruptcy and provide new financing.
As Consumer Privacy Ombudsman, Salazar will serve as an independent third party responsible for protecting the personally identifying information of Alamo Drafthouse Cinemas customers from misuse or inappropriate transfers.
In fact, it was Salazar who drafted and lobbied for the passage of The Privacy Policy Enforcement in Bankruptcy Act, the only law of its kind, which prohibits bankrupt companies from misusing information. The law requires the appointment of a Consumer Privacy Ombudsman.
In the years following the Act’s passage, the Department of Justice has appointed Salazar as Consumer Privacy Ombudsman to monitor the data of approximately 40 million consumers in nearly 25 matters, including the bankruptcies of Tweeter Audio, Foxtons, ViCorp, North General Hospital, DOTS, BonTon Stores, Advanced Sports and now Alamo Drafthouse Cinemas.
To best serve clients in this continually evolving area, Salazar created the Consumer Privacy Ombudsman and Public Watchdog Services practice group at Salazar Law. Salazar and the team have been recognized by the National Law Journal and the Daily Business Review as trailblazers and innovators in the data privacy realm.
For more than 25 years, Salazar has been battling for individuals and companies facing financial or regulatory crisis. As a litigator and restructuring attorney, he has represented businesses and individuals in hundreds of matters in Federal and State courts throughout the country. He has led the Chapter 11 reorganization efforts of numerous well-known companies in a variety of industrial sectors with combined assets in the billions of dollars.
Salazar Law, LLP, a minority-owned boutique law firm in Coral Gables, serves individuals and businesses facing financial crisis, data privacy and compliance matters, complex commercial litigation or government investigations, as well as those looking to seize financial or business opportunities.
